Privacy Statement

Appaccord, Inc. (dba Unific, “we,” “us,” “our”) values the privacy of those who visit our websites and register for our software and services online. We think it is important for you to understand when and why we collect personally identifiable information and how we may use it. This Privacy Statement describes Unific's data collection and use policies. Please read the entire Privacy Statement before providing any personally identifiable information to us.

Notice

Unific collects personally identifiable information (PII), such as your name, address, telephone number, or e-mail address, only if you provide this information to us voluntarily. Unific may collect PII when you register with Unific and/or use Unific products or services (“Services”) and/or to submit inquiries to us. The voluntary information we collect is used to complete transactions; ensure appropriate legal use of licensed Unific software; provide notification to licensees about updates to Unific and our affiliates’ software, data, and services; and help provide technical and product support to our users. Where appropriate, Unific may pass this data to a Unific affiliate or vendor whose software, data, and services are used to meet your needs or process transactions. Our affiliates and vendors are also committed to protecting personally identifiable information as described in their privacy statements/policies.

Unific may also use your name, address, and e-mail to send you marketing materials, and newsletters unless you notify us that you do not want to receive these materials.

Unific assumes no responsibility for the privacy practices of third parties’ websites and suggests you review the privacy statements/policies on such websites before sharing your personally identifiable data.

Collection

Certain information, such as the Internet Protocol (IP) address of your computer, may be stored through the use of “cookies” intended to speed access to Unific information and services. A cookie is a small file that can be used to tell us when you visit our websites and track your browsing preferences. Unific does not use cookies to store information such as credit card numbers, telephone numbers, or other information you provide. To maintain your privacy, you can disable your browser’s ability to accept cookies.

Unific may also collect personally identifiable information you provide when you order and register software, data, or services; enter contests; order newsletters; register for training or conferences; or make requests that require a direct response to you.

Unific's website uses third-party web analytics services that collect and aggregate web surfing data. These services may record your mouse clicks, mouse movements, scrolling activity, and any text you type in the website. The services do not collect personally identifiable information that you do not voluntarily enter in Unific's website and do not track your browsing habits across websites that do not use the services.

Web Beacons/Click-Stream Data

A web beacon is an electronic file that signals when a webpage, advertisement, video, other content, an email, or a newsletter has been viewed. Unific uses web beacons in conjunction with cookies to collect click-stream data that helps us better understand how visitors move from page to page within websites. As with cookies, our web beacons do not gather personally identifiable (PI) information about you.

Choice

If you submit personal information, Unific may contact you or send you marketing information about software or services. If you do not wish to receive this information, you may notify us by sending an e-mail to support@unific.com as indicated below. Keep in mind, however, that you may not receive valuable information as a result of your election to be removed from mailing lists.

Other than as described in this Privacy Statement, Unific will not disclose or authorize others to disclose your personally identifiable information unless required to do so by law or in the good faith belief that such action is necessary to (1) conform to legal requirements or prevent fraud or imminent harm, (2) protect and defend the rights or property of Unific, or (3) as part of a transfer of assets to a successor in interest.

Except as stated, Unific does not rent, sell, or otherwise share personally identifiable information.

Access

Unific will permit you to access information about you in our database by contacting support@unific.com. If you believe any of the information is incorrect or needs updating, please advise us. We will correct our records upon verification of the requested change. If you no longer wish to receive e-mail or postal notifications about software, services, or special promotions, please let us know by sending an e-mail to us at support@unific.com and specifying that you do not want to receive these notifications. Please provide us with your exact name and address as well as a description of the publication or mail piece you received. We will use reasonable efforts to refrain from including you when sending marketing materials to Unific clients by noting your election in our database.

Security

Unific will take reasonable and prudent precautions to ensure that your personally identifiable data is protected against unauthorized access, use, or disclosure.

Enforcement

If you believe for any reason that Unific has not followed these principles, please contact us at support@unific.com and Unific will act promptly to investigate, correct as appropriate, and advise you of the correction. Please identify the issue as a Privacy Statement concern in your communication to Unific.

Social Media Public Forums and Links to Other Websites

Unific may provide social media features that enable you to share information with your social networks and interact with Unific on various social media websites. Your use of these features may result in the collection or sharing of information about you, depending on the feature. We encourage you to review the privacy policies and settings on the social media websites with which you interact to make sure you understand the information that may be collected, used, and shared by those websites.

Our websites may make chat rooms, forums, blogs, message boards, and/or news groups available to its users. Remember that your comments and posts become publicly available, and we urge you to exercise discretion when submitting such content.

Our websites may contain links to other websites. Unific does not control and is not responsible for the information collected by websites that can be reached through links from our websites. If you have questions about the data collection procedures of linked websites, please contact the organizations that operate those websites directly.

Children’s Online Privacy

Unific's products and services are not directed to children and Unific does not knowingly collect online personal information from children under the age of 13. If you are a parent or guardian of a minor under the age of 13 and believe that he or she has disclosed personal information to us, please contact us via support@unific.com or via “Contact Us” at unific.com.

Data Transfers and Data Privacy Framework

Unific is a global organization, with legal entities, business processes, and technical systems that operate across borders. Unific may transfer your personal information to other Unific entities in the United States and elsewhere. The United States and other countries may not have the same data protection laws as the country from which you initially provided the information. By accessing Unific's websites, registering for an account or service, or otherwise providing Unific with your personal information, you consent to this transfer of your personal information. When transferring your personal information internationally, Unific will protect your personal information as provided in this Privacy Statement.

PERSONAL DATA TRANSFERRED FROM THE EU OR SWITZERLAND TO THE UNITED STATES

Unific currently uses data center facilities located exclusively in the United States. Your information will be stored and processed in the United States or other countries where we decide to maintain data center facilities in the future. By using Unific products and Services, you consent to the transfer of information outside of your country, even if your country has more rigorous data protection standards. For any Personal Information that may be transferred from the European Economic Area, please see the EU Individuals section below.

Unific complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce.  Unific has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF.  Unific has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.  If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern.  To learn more about the Data Privacy Framework (DPF) Program, and to view our certification, please visit https://www.dataprivacyframework.gov/

The Federal Trade Commission has jurisdiction over Unific’s compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) and to the rights of EU and UK individuals and Swiss individuals.

Pursuant to the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) and to the rights of EU and UK individuals and Swiss individuals have the right to obtain our confirmation of whether we maintain personal information relating to you in the United States. Upon request, we will provide you with access to the personal information that we hold about you. You may also correct, amend, or delete the personal information we hold about you. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data transferred to the United States under Data Privacy, should direct their query to support@unific.com. If requested to remove data, we will respond within a reasonable timeframe.

We will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. To request to limit the use and disclosure of your personal information, please submit a written request to support@unific.com.

In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Unific’s accountability for personal data that it receives in the United States under the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) and to the rights of EU and UK individuals and Swiss individuals and subsequently transfers to a third party is described in the DPF Principles. In particular, Unific remains responsible and liable under the DPF Principles if third-party agents that it engages to process personal data on its behalf do so in a manner inconsistent with the Principles, unless Unific proves that it is not responsible for the event giving rise to the damage.

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Unific commits to resolve DPF Principles-related complaints about our collection and use of your personal information.  EU and UK individuals and Swiss individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF should first contact Unific at:

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Unific commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF to Unific, an alternative dispute resolution provider based in the United States.  If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit https://bbbprograms.org/programs/all-programs/dpf-consumers for more information or to file a complaint.  The services of BBB National Programs are provided at no cost to you.

Unific EU Addendum to Privacy Policy

EU Individuals

If you are located in the European Union (“EU”), United Kingdom, Lichtenstein, Norway, or Iceland, you may have additional rights under the EU General Data Protection Regulation (the “GDPR”) with respect to your Personal Data, as outlined below.

For this GDPR Privacy Notice, we use the terms “Personal Data” and “processing” as they are defined in the GDPR, but “Personal Data” generally means information that can be used to individually identify a person, and “processing” generally covers actions that can be performed in connection with data such as collection, use, storage and disclosure. Appaccord, Inc. (dba Unific) will be the controller of your Personal Data processed in connection with the Services.

Where applicable, this GDPR Privacy Notice is intended to supplement, and not replace, Unific's Privacy Policy at https://unific.com/privacy (the “Privacy Policy”). If there are any conflicts between this GDPR Privacy Notice and Unific's Privacy Policy, the policy or portion that is more protective of Personal Data shall control to the extent of such conflict. Note that we may also process Personal Data of our customers’ end users or employees in connection with our provision of Services to customers, in which case we are the processor of Personal Data. How and With Whom Do We Share Your Data?

We share Personal Data with vendors, third-party service providers and agents who work on our behalf and provide us with services related to the purposes described in this Privacy Policy or our Terms of Service. A list of such vendors, third-party service providers and agents can be found in the Subprocessors section at the bottom of this page.

We also share Personal Data when necessary to complete a transaction initiated or authorized by you or provide you with a product or service you have requested. In addition to those set forth above, these parties also include:

We also share information with third parties when you have given us consent to do so (as indicated at the point such information is collected). We also share Personal Data when we believe it is necessary to:

  • Protect us, our business or our users, for example to enforce our Terms of Service, prevent spam or other unwanted communications and investigate or protect against fraud
  • Maintain the security of our products and services

If we choose to buy or sell assets, user information is typically one of the transferred business assets. Moreover, if we, or substantially all of our assets, were acquired, or if we go out of business or enter bankruptcy, user information would be one of the assets that is transferred or acquired by a third party, and we would share Personal Data with the party that is acquiring our assets. You acknowledge that such transfers may occur, and that any acquirer of us or our assets may continue to use your Personal Information as set forth in this policy.

How Long Do We Retain Your Personal Data?

We retain Personal Data about you for as long as you have an open account with us and for 3 years after you close your account. In some cases we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. Afterwards, we retain some information in a depersonalized or aggregated form but not in a way that would identify you personally. However, user signup data (your name, your email address, and the fact that you were a Unific user) may be retained in third-party analytics services beyond closure of your account, unless you request that your data be deleted.

Whenever you interact with our Services, we automatically receive and record information on our server logs from your browser or device which may include “cookie” information. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Services are visited and by how many people.

What Security Measures Do We Use?

We seek to protect Personal Data using appropriate technical and organizational measures based on the type of Personal Data and applicable processing activity. For example, Unific is continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unauthorized access, loss, destruction or alteration. Some of the safeguards we use to protect Personal Data are firewalls, data encryption, and information access controls.

Personal Data of Children

As noted in our Privacy Policy, we do not knowingly collect or solicit Personal Data from anyone under the age of 13. If you are under 13, please do not attempt to register for the Services or send any Personal Data about yourself to us. If we learn that we have collected Personal Data from a child under age 13, we will delete that information as quickly as possible. What Rights Do You Have Regarding Your Personal Data?

You have certain rights with respect to your Personal Data, including those set forth below. For more information about these rights, or to submit a request, please email support@unific.com. Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision. In some cases, we may also need you to provide us with additional information, which may include Personal Data, if necessary to verify your identity and the nature of your request.

  • Access: You can request more information about the Personal Data we hold about you and request a copy of such Personal Data. You can also access certain of your Personal Data by accessing your account settings.
  • Rectification: If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data. You can also correct some of this information directly by accessing your account settings.
  • Erasure: You can request that we erase some or all of your Personal Data from our systems.
  • Withdrawal of Consent: If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Data, if such use or disclosure is necessary to enable you to utilize some or all of our Services.
  • Portability: You can ask for a copy of your Personal Data in a machine-readable format. You can also request that we transmit the data to another controller where technically feasible.
  • Objection: You can contact us to let us know that you object to the further use or disclosure of your Personal Data for certain purposes.
  • Restriction of Processing: You can ask us to restrict further processing of your Personal Data.
  • Right to File Complaint: You have the right to lodge a complaint about Unific’s practices with respect to your Personal Data with the supervisory authority of your country or EU Member State.
